The question is addressed in Section 517.13(A) and (B). The equipment grounding conductor in the cable assembly is required to be copper and must be insulated. The cable referred to in your question would not be in compliance. Remember that Chapter 5 of the NEC modified or amends the general requirements in Chapters 1 through 7 of the Code, per 90.3. In this case, the requirement is more restrictive than what could be permitted for a general location.
